Welcome to Caption Home. These Terms of Service ("Terms") govern your access to and use of our website, and the purchase of any products or services through it (together, the "Services"), operated by Caption Home ("we," "us," "our"). By accessing or using the Services, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services or place an order. By using the Services, you represent that you meet this requirement.

2. Products, Pricing & Availability

  • All prices are listed in Indian Rupees (INR) and are displayed to all customers, including international buyers, unless otherwise stated at checkout.
  • We make reasonable efforts to display product colors, materials, and details accurately; however, slight variations (e.g., due to screen display or handmade/fabric variation) may occur and do not constitute a defect.
  • Prices, product descriptions, and availability are subject to change without notice.

3. Order Acceptance & Cancellation by Us

Placing an order does not guarantee acceptance. We reserve the right to refuse, limit, or cancel any order, at our discretion, including in cases of:

  • Pricing or listing errors
  • Stock unavailability
  • Suspected fraudulent, unauthorized, or illegal activity
  • Errors in your order or account information

If we cancel an order after payment has been collected, you will receive a full refund to your original payment method.

4. Shipping, Returns & Refunds

Shipping timelines and costs are set out in our Shipping Policy. Returns, exchanges, and refunds are governed by our Refund & Return Policy. Both are incorporated into these Terms by reference.

5. Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [Support Email] if you suspect unauthorized use of your account.

6. Intellectual Property

All content on the Services — including text, graphics, logos, product images, designs, and the Caption Home name and branding — is owned by or licensed to Caption Home and is protected by applicable intellectual property laws. 7. User-Generated Content

If you submit reviews, comments, images, or other content to the Services (e.g., product reviews), you grant Caption Home a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing. You are solely responsible for any content you submit and confirm you have the right to share it.

8. Prohibited Uses

You agree not to use the Services to:

  • Violate any applicable law or regulation

11. Limitation of Liability

To the fullest extent permitted by applicable law, Caption Home shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or any products purchased, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or your order shall not exceed the amount you paid for the relevant order.

Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Indian consumer protection law.

12. Indemnification

You agree to indemnify and hold Caption Home, its owners, employees, and affiliates harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Services.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Services shall first be attempted to be resolved amicably. If not resolved within 30 days, the dispute shall be referred to and finally resolved by arbitration conducted by a sole arbitrator, in accordance with the Arbitration and Conciliation Act, 1996, seated in New Delhi, India. The arbitration proceedings shall be conducted in English, and the arbitrator's award shall be final and binding on both parties. Subject to the above, the courts of New Delhi shall have exclusive jurisdiction over any matters not subject to arbitration.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted on this page with an updated "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

This document is a template and should be reviewed by a qualified lawyer before publishing — particularly Section 13, since arbitration clauses under Indian law require a single, clearly defined seat of arbitration (you named both New Delhi and Haryana, which needs to be resolved to one location for the clause to be enforceable), and Section 11, since limitation-of-liability clauses can be partly overridden by India's Consumer Protection Act, 2019 for B2C sales.
